WILLIAM ZALEWSKI, PLAINTIFF v. OVERLOOK HOSPITAL, DEFENDANT., 300 N.J. Super. 202
Summary
Plaintiff employee was mocked, ridiculed, and otherwise harassed at work by other men for not being sufficiently masculine. He filed a suit for damages under the New Jersey Law Against Discrimination (LAD), N.J. Stat. Ann. § 10:5-1 et seq., claiming sexual harassment. The court denied defendant employer's motion for summary judgment, and held that LAD encompassed same sex discrimination based on gender stereotyping, and held that plaintiff's cause of action was within LAD.
