Summary

This survey addresses employer workers' compensation liability coverage, encompassing an employer's option to self-insure, the workers' compensation insurance policy deductibles, and unique statutory provisions for workers' compensation coverage or payment of claims. The survey covers all 50 U.S. states, Puerto Rico, Guam, Virgin Islands, and the District of Columbia. Federal law does not address these issues because state laws and regulations control them. Most states require employers to carry workers' compensation insurance coverage and regulate which employers must provide the coverage and what type of coverage must be in place. States impose a variety of regulations on workers' compensation and employers' liability insurance carriers. They may provide for particular insurance policy provisions and business practices.
