Summary

This warranty deed may be used by a seller/grantor to transfer title to Arizona commercial real estate to a buyer/grantee. This template presumes a transaction between two business entities. This template includes practical guidance, drafting notes, and optional clauses. An Arizona deed must be in writing, signed by the grantor, acknowledged, and delivered. See Ariz. Rev. Stat. §§ 33-401(A) and (B). This warranty deed template contains the conveyance language in the statutory form of warranty deed found in Ariz. Rev. Stat. §§ 33-402(2) and (3) and incorporates additional deed requirements mandated by other Arizona statutes relating to the form and content of deeds submitted for recording in the state. In the case of a bank or business entity, the deed should include the state in which the grantee is incorporated, organized, licensed, chartered, or registered, together with the name of the country under which the grantee was formed (though in practice "United States of America" is often not included for a domestic organization and the validity of the deed is not affected by this omission).
