Summary

This template is used for a trustee's resignation. It provides for the proper construction for the resignation of the acting trustee and appointment of a successor trustee to continue the operation of the trust in Florida. This template contains practical guidance, drafting notes, and optional clauses. Trustee resignation can be accomplished without court intervention under Fla Stat. § 736.0705, if proper notice is given to all current beneficiaries, settlors (if still living), and co-trustees, if any. The trust document should be reviewed, as well, to determine any requirements listed therein to carry out the trustee resignation.
