Tripartite Insurance Relationships: Ethical Considerations
Summary
This practice note discusses some of the ethical implications of the tripartite insurance relationship. It will cover those brought about by the very nature of general attorney-client relationships, those raised by representative State Bar rules (when State Bars have addressed them in the insurance context), ABA pronouncements, and some gleaned from litigation. It is intended to guide counsel concerning their oft-complicated duties arising from what can sometimes seem to be serving multiple masters.
