Transfer Tax Affidavit (CA)

Summary

This form is an affidavit that, in certain counties, must accompany any conveyance of real property when Documentary Transfer Tax is being paid or when an exemption is claimed from the payment of the tax. Currently, the form is required in the counties of El Dorado, Merced, Riverside, San Bernardino, San Francisco, San Joaquin, San Mateo, and Santa Barbara. Prior to recording a deed, the practitioner should check with the county recorder's office where property is located to determine whether an affidavit will be required, and if so, to download that particular county's version of the form from the county recorder's website.
