Summary
This template Trademark Infringement Cease and Desist Letter should be used in many cases as a first step in enforcing a client's trademark rights against infringement, unfair competition, and, in some instances, cybersquatting and/or dilution. This template includes practical guidance, drafting notes, alternate clauses, and optional clauses. The purpose of the letter is to educate the infringer about the trademark owner's rights, put the infringer on notice of the infringing activities, and make specific demands, with an implied threat of legal action if the trademark owner's concerns are not resolved within a specified timeframe.
