JOROME TIMS et al., Appellees, v. BLACK HORSE CARRIERS, INC., Appellant., 2023 IL 127801

Summary

HOLDINGS: [1]-Because the Biometric Information Privacy Act did not have its own limitations period, because the subsections of 740 ILCS 14/15 were causes of action "not otherwise provided for," and because the court had to ensure certainty, predictability, and uniformity as to when the limitations period expired in each subsection, the act was subject to the default five-year limitations period found in 735 ILCS 5/13-205; furthermore, this longer limitations period would comport with the public welfare and safety aims of the General Assembly by allowing an aggrieved party sufficient time to discover the violation and take action.
