Summary

This tracker identifies cases and decisions in which third-party releases are contested or the requested relief is implicated as a result of the Supreme Court's ruling in Harrington v. Purdue Pharma L.P., 144 S. Ct. 2071 (2024) (Purdue). In Purdue, the Supreme Court held that the Bankruptcy Code does not authorize non-consensual third-party releases, i.e., releases that seek to discharge claims against a non-debtor without the consent of affected claimants.
