Summary
This template termination of memorandum of lease may be used to terminate a recorded memorandum of lease for California commercial real property. This template contains practical guidance, drafting notes, and an alternate clause. A memorandum of lease is recorded in the office of the county recorder in the county where the leased premises is located to give third parties notice of the existence of the lease. When the lease either expires or is terminated, a termination of memorandum of lease may be recorded by the landlord to clear title to the leased premises. If the lease allows the parties to record a memorandum of lease, the landlord should always require the tenant to execute a termination of the memorandum when the lease expires or is terminated.
