Summary

This a subpoena to attend and testify pursuant to the Pa. R. Civ. P. 234.6. You should use this template to subpoena/require a non-party to attend and testify. The template also includes a return of service, which usually appears on the reverse side of the subpoena but can be created and filed as a separate document. This template contains alternate and optional clauses, practical guidance, and drafting notes. This template requires a person to attend a hearing or trial, as well as to produce designated books, papers, documents, or tangible things. Pa. R. Civ. P. 234.1(a). Pennsylvania procedural rules provide that, upon the request of a party, the prothonotary is required to issue a subpoena substantially in the form prescribed by Pa. R. Civ. P. 234.6, which is signed by the prothonotary and under the seal of the court, but otherwise in blank, for completion by the party. Accordingly, you should obtain any Rule 234 Subpoena form directly from the prothonotary's office of the county courthouse. These forms are pre-printed and they contain the signature and seal required by this Rule. Pa. R. Civ. P. 234.2(a). There is usually a small fee ($3–$5) for each subpoena from the prothonotary.
