Summary

This template is a subpoena for documents and/or testimony that may be used during discovery in New Jersey civil cases. This template includes practical guidance, drafting notes, and alternate and optional clauses. You can use a subpoena to compel someone to: • Attend and testify at a deposition, hearing, or trial • Produce documents, things, or electronically stored information at a deposition N.J. Ct. R. 1:9-1 (R.); R. 1:9-2; R. 4:14-7. Two major provisions govern the use of subpoenas in civil actions: • R. 1:9 regulates the use of subpoenas generally, and directly governs the subpoena to secure the attendance of a witness at a trial or hearing • R. 4:14-7 regulates discovery subpoenas Indeed, a subpoena for taking a deposition is governed by R. 4:14-7, which in turn provides that the form of a discovery subpoena must comply with R. 1:9.
