Subpoena for Documents and/or Testimony

Summary
This discovery subpoena template is for use in a civil action in Georgia state or superior court. It allows a party to command a nonparty to attend and testify at a deposition, produce documents or things, and/or permit entry on the nonparty's premises for inspection. This template includes practical guidance, drafting notes, and an alternate clause. O.C.G.A. § 24-13-20 et seq. and O.C.G.A. § 9-11-45 set forth the rules for preparing, issuing, serving, and enforcing subpoenas on nonparties in Georgia civil litigation. A subpoena is a court order requiring the person or organization named therein to give testimony or provide other evidence in the case. See O.C.G.A. § 24-13-21(b). A party can use a subpoena to compel: • Testimony from a nonparty witness • Production of documents or tangible things from a nonparty witness –or– • The inspection of a nonparty's premises A discovery subpoena must include the following: • The name of the court • The name of the clerk • The title of the proceeding • The name of the person being subpoenaed, if known • The date, time, and location of the deposition and/or where the documents or things must be produced • The items to be produced, if any • Notice to produce and/or deposition notice • A caption (see Ga. Unif. Super. Ct. R. 36.3) • Clerk and attorney signature O.C.G.A. §§ 24-13-21, 9-11-45.
