Sub-Sublease (Portion of the Subleased Premises)


Summary

This precedent is used for a subtenant under a sublease who wishes to further sublease a portion of the subleased premises to a subtenant (the "Sub-Subtenant"). This precedent contains practical guidance and drafting notes. Typically, the consent of the landlord (the "Head Landlord") under the original lease (the "Head Lease") and the sublandlord (the "Sublandlord") under the sublease (the "Sublease") will be required. However, in certain circumstances the consent of the Sublandlord will not be required. Such as if the Subtenant, under the Sublease, was able to negotiate the right to sublet without the Sublandlord's consent. This is often the case if the Subtenant knows it will want to further sublease to a related entity.
