Summary

This statutory landlord's lien state law survey examines landlord's lien laws in each of the 50 states and the District of Columbia. Specifically, this survey focuses on statutory landlord's liens against a tenant's personal property for rent. Landlord's liens granted for purposes other than recovering unpaid rent (e.g., liens for advances, tools, or equipment) or that encumber only tenant's abandoned property or certain other specific items (e.g., crops, mobile homes, recreational vehicles, etc.) are beyond the scope of this survey; any references herein to such liens are for convenience only. In addition, the landlord's lien statutes of certain states contain provisions relating to tenants who have been adjudged bankrupt; such provisions are not addressed in this survey.
