Statement of Defence, Counterclaim and Crossclaim (Claim for Lien) (ON)
Summary
This precedent is a statement of defence, counterclaim, and crossclaim of the defendant in a claim for lien action. It contains practical guidance and drafting notes. While the Construction Act, R.S.O. 1990, c. C.30, contemplates only two pleadings in the action, the Statement of Claim and the Statement of Defence, the defendant may assert a counterclaim against the plaintiff when defending the action and may also crossclaim against another defendant. In general, the contents of the Statement of Defence in a construction lien action will be similar to those in an ordinary action, except for specific pleas relating to the peculiar remedy that the plaintiff is seeking to assert.
