STATE OF IOWA, Plaintiff-Appellee, vs. JEREMY LEE SCHROEDER, Defendant-Appellant., 885 N.W.2d 217
Summary
HOLDINGS: [1]-The evidence was sufficient to sustain defendant's conviction for conspiracy to manufacture more than five grams of methamphetamine under Iowa Code § 124.401 because the State introduced evidence that defendant's fiancée had been living with him in the home where an "old cook" had recently occurred, defendant and his fiancée had been regularly taking turns buying pseudoephedrine, and defendant had enough pseudoephedrine to produce a "theoretical yield" of 5.52 grams of methamphetamine; [2]-The evidence was sufficient to sustain defendant's conviction for possession of anhydrous ammonia with intent to manufacture methamphetamine under Iowa Code § 124.401 because the officer released the valve on the tank that was still under pressure, and when doing so, he smelled anhydrous ammonia, and he testified that he had "been exposed to it, witnessed it, and smelled it in the past."
