Summary
Plaintiff employer brought suit against defendants, three of its former employees, asking the court to enjoin them from working for third-party for 18 months, and from breaching non-disclosure and non-solicitation agreements they had signed with plaintiff. Third-party filed a motion to intervene. The court held that the covenants signed by defendants were covenants not to compete, not forfeitures for competition, as defendants asserted. The court further held that plaintiff had a reasonable likelihood of success on its claim that defendants had violated the covenant not to solicit plaintiff's clients or its employees. Plaintiff's request for injunctive relief was granted to the extent that defendants were enjoined from soliciting employment of any person who within the previous 12 months was an officer of, or held a position of comparable responsibilities with plaintiff, and from engaging in solicitation of any business from any client of plaintiff.
