Summary

Appellants, personal representative of deceased and gaming corporation, sought review of the district court's granting of summary judgment in favor of appellee insurance company. The deceased was injured on the premises of appellant gaming corporation. Following the accident, appellant personal representative of deceased sued appellant gaming corporation to recover for the injuries they sustained. During the course of trial, appellants reached an agreement. Appellants then filed separate lawsuits against appellee to recover under appellee's policy.
