The trial court's grant of summary judgment in favor of appellee was premature. Appellants had sufficiently pled the affirmative defense of unclean hands and appellee had neither factually nor legally refuted the affirmative defense. Appellee, in its motion for summary judgment, simply advanced a bare legal argument that the unclean hands defense was legally insufficient.
