Severability Clauses

Summary

This practice note discusses the inclusion of a severability clause in the boilerplate section of an agreement and provides a model sample of a severability clause. Such clauses show the parties' intent to retain valid portions of a contract even though certain parts of the contract may be illegal, invalid or unenforceable.
