Settlement and Separation Agreement Checklist (Pro-Employer)


This checklist highlights the main points to consider when negotiating and drafting a settlement or separation agreement on behalf of an employer. For an employer, a settlement or separation agreement serves many purposes when confronted with potential litigation from an aggrieved employee. Most importantly, the agreement should provide for a release of all claims against the employer. However, the agreement may also contain other important provisions including, among others, confidentiality, method of payment, and continued employee cooperation.
