Summary

This precedent is an entire s. 9 representation agreement for the provision of health care made pursuant to the Representation Agreement Act, R.S.B.C. 1996, c. 405 ("RAA"). This precedent includes practical guidance and drafting notes. If an adult living in British Columbia wishes someone to make health or personal care decisions on his or her behalf, or decisions regarding the routine management of the adult's financial affairs if he or she becomes incapable of doing so, he or she must execute a representation agreement in accordance with the RAA. A person must become incapable with respect to a specified matter before the representative is able to make decisions about that specified matter. This sample agreement permits appointment of multiple alternative representatives if the representative is unable or unwilling to continue to act, and that disputes between the representatives must be decided by a majority.
