Summary
This tracker provides a summary of recent Federal Trade Commission (FTC) enforcement actions involving Section 5 of the FTC Act in the behavioral or conduct context, rather than in the merger context. Section 5(a) of the FTC Act, 15 U.S.C. § 45(a), prohibits "unfair methods of competition," which include violations of the Sherman Act and also certain standalone violations, including invitations to collude, which are not illegal under the Sherman Act. The FTC Act authorizes the FTC to bring cases in federal court and in internal administrative proceedings.
