Scope of Work for Phase I ESA
Summary
This Scope of Work (SOW) template is for a Phase I Environmental Site Assessment (ESA), which has been prepared in connection with the proposed purchase of real property. This template includes practical guidance. The goal of a Phase I Environmental Site Assessment Report (Real Estate Glossary) is to evaluate readily-available evidence to identify sources of potential environmental liability and risk on the subject property. The SOW focuses on specific site conditions, based on the site history, and response actions are targeted to the development project planned for the site. The SOW for a consultant can vary in detail, and wetland studies, cultural or historical resources, and threatened or endangered species evaluations often may not be included in the basic scope of work. For a related template see Environmental Site Assessments Letter Agreement (Lender to Perform Phase I). For guidance on selecting an environmental consultant, see Environmental Law in Real Est. & Bus. Transactions § 23.03. For more information generally on due diligence, see Environmental Due Diligence in Real Estate Transactions.
