This practice note discusses sanctions that may be imposed on a party to a civil action in California superior court and/or on a party's attorney under Cal. Code Civ. Proc. §§ 128.5 and 128.7 for certain types of improper litigation conduct. This note discusses the grounds and procedures for imposing such sanctions. This note also briefly discusses sanctions that may be imposed for violation of court orders or court rules, as well as procedures and practices for opposing imposition of sanctions.
