HOLDINGS: [1]-In a putative class action on behalf of all participants, former participants, and beneficiaries of a health pension plan, plaintiffs adequately alleged that the plan was not properly maintained as a church plan under 29 U.S.C.S. § 1002(33)(C)(i) of the Employee Retirement Income Security Act of 1974 because the plan was "maintained" by defendant for its own and its affiliates' employees, and defendant was neither a church, a convention or association of churches, nor an organization whose principal purpose or function was the administration or funding of the Plan as required by § 1002(33)(C)(i).
