Robinson-Patman Act Section 2(f) Buyer Liability


Summary

This practice note discusses liabilities buyers might face under section 2(f) of the Robinson-Patman Act. Specifically, Section 2(f) imposes liability on a buyer that knowingly induces or receives a discrimination in price that is prohibited by the Robinson-Patman Act. Although the Robinson-Patman Act was enacted as a response to supposed abuses of power by “big buyers,” nearly all of its provisions are aimed at sellers. Only Section 2(f), the final section of Robinson-Patman imposes liability on a favored buyer.
