Summary

This template is used to revoke a transfer on death (TOD) deed previously recorded by a California property owner. This template contains practical guidance and drafting notes. Other methods of revoking a revocable TOD deed include: (1) recording a subsequent TOD deed for the same property; or (2) transferring the property during the owner’s life. See Cal. Prob. Code § 5628. The property owner does not need to notify the beneficiary nor gain their consent to revoke the revocable TOD deed. Cal. Prob. Code § 5632(b). In order to be effective, a revocation of revocable TOD deed must be recorded before the owner’s death in the county in which the property is located. Cal. Prob. Code § 5632(a). This template is based on the statutory Revocation of Revocable Transfer on Death Deed, which appears in Cal. Prob. Code § 5644.
