Response to Application (Document Production and Information Requests) (BC)

Summary

This precedent is the plaintiff's response to the defendants' application for relief in the context of a slip and fall accident claim, pursuant to the Supreme Court Civil Rules, B.C. Reg. 168/2009. This precedent includes practical guidance and drafting notes. The defendants sought an order requiring that the plaintiff provide certain information and documents pursuant to the examination for discovery and that the examination continue. In the response, the plaintiff agrees to produce some of the documents or claims that they have already been provided. The plaintiff argues in this response that some of the documents requested are irrelevant and constitute a fishing expedition. Finally, the plaintiff claims that further examination will cause considerable stress and expense and is unnecessary. For more information on applications, see the practice note: Applications (BC).
