Summary
This is a template for a request to correct an official filing receipt of a patent application issued by the United States Patent and Trademark Office (USPTO). This template includes practical guidance and drafting notes. Requests for correction may be made to correct any information in the official filing receipt mailed by the USPTO (e.g., an inventor's name, the applicant's name, priority benefit data, or a missing application number). Patent practitioners should review a patent application's official filing receipt for errors as soon as it is received. Correction of errors in the official filing receipt is not required. However, correction protects against potential future problems should you ever require official evidence of the basic filing and bibliographic data associated with the application. In particular, when you make any other request for a change in application data, such as a request to change or update the applicant's name, it is generally considered best practice to concurrently file a request for a corrected official filing receipt. Note that no filing fee is associated with the request for a corrected official filing receipt. The request should be accompanied by a corrected Application Data Sheet (ADS) showing the requested changes. The corrected ADS accompanying the request consists of an annotated copy of the original ADS, with the requested additions underlined and any deletions indicated using strikethrough. You can edit the PDF version of the ADS, however, the most common way to prepare a corrected ADS is by printing the original ADS on paper, making the requested corrections by hand, and then scanning the paper document for filing. It is important that your request is correctly filed and displayed in the file history. You should, therefore, include the following caption in a header on each page of your request: Request for Correction of Official Filing Receipt Attorney Docket No. [Attorney docket number] Application No. [Application number] Each page should be numbered to ensure that every page has been properly filed and to facilitate reference to a particular page of the request in the future, if necessary.
