This practice note provides guidance about reinsurance disputes and their resolution. It will address preparation for dispute resolution processes and engagement in those processes in the context of reinsurance. In general, dispute resolution can follow a similar course(s) in reinsurance as in other insurance matters like COVID-19 disputes. But the history, customs, and characteristics of reinsurance can alter the process of resolving conflicts between reinsurers and cedents and between reinsurers inter se. Furthermore, rules of interpretation and the very vocabulary of reinsurance can distinguish it from how disputes are handled in other matters that have a nexus to insurance.
