Summary

This state law survey provides an overview of interests that may be mortgaged, disclosure, effect of mortgage, assignment of mortgage, satisfaction and release of mortgage, and damages for failure to release satisfied mortgages. This state law survey includes relevant statutes and regulations addressing authorization of deeds of trust, timely release of mortgages, and penalties for failure of timely release of mortgages in each of the 50 U.S. states, the District of Columbia, and U.S. territories. This survey covers only state laws and regulations due to the lack of federal treatment of the issues in focus.
