Summary

This state law survey provides an overview of real estate licensing statutes governing specific prohibited practices as well as liabilities and penalties for violations thereof in each of the 50 U.S. states, the District of Columbia, and U.S. territories. Highlighted issues include prohibitions, limitations, and restrictions on compensation and commission-sharing between licensed and unlicensed individuals and business entities in commercial real estate transactions; civil and criminal penalties for engaging in the unlawful practice of real estate or unlawfully receiving real estate commissions; restrictions and limitations on offering rebates of real estate commissions to consumers; limitations on sharing commissions with out-of-state licensees; and exemptions and safe harbors.
