Product Placement Agreement
(Pro-advertiser)
Summary
This template is a product placement agreement, drafted in favor of the advertiser, where one party (generally, a production entity such as a film studio) is permitted to feature another party's product, including related intellectual property rights, in the development, production, and exploitation of a television, film, commercial, or other audio-visual production. This template includes practical guidance and drafting notes. Product placement allows marketers to target a specific demographic or geographic by placing their products in specific productions directed at certain groups of people who are considered the most likely consumers of the merchandise in question. Product placement is a particularly effective marketing strategy for reaching those individuals who are averse to traditional advertising and either turn off or ignore commercials that push products directly in their faces. This template is jurisdiction and industry neutral and may require amendment to the extent necessary to comply with applicable law.
