Private Attorneys General Act in California: Defending against PAGA Claims

This practice note provides guidance to employers in defending against claims brought under California's Private Attorneys General Act (PAGA), which is enumerated in the California Labor Code as Labor Code § 2699, et seq. Under PAGA, "aggrieved employees" may step into the state's shoes and bring actions to recover civil penalties on behalf of the state, themselves, and other current or former California employees for certain violations of the California Labor Code or workplace health and safety violations.
