Pregnancy and Parental Leave Policy

Summary

This template is a pregnancy and parental leave policy that has been tailored for employers subject to Nevada state law. This template includes practical guidance, drafting notes, and alternate and optional clauses. Nevada's Pregnant Workers' Fairness Acts (PWFA) requires covered employers to provide reasonable accommodations to pregnant employees. Employers with 15 or more employees each working day in each of 20 or more calendar weeks in the current or preceding calendar year are covered under the PWFA. Nev. Rev. Stat. Ann. § 613.310(2); 2017 Nev. SB 253, § 19(2). The PWFA protects employees affected by pregnancy, childbirth, or related medical conditions. 2017 Nev. SB 253, § 5. Note that the federal Pregnant Workers Fairness Act that recently took effect does not preempt corresponding state law, but may expand upon an employee's rights. Further, employers are obligated to provide leave for conditions related to pregnancy and childbirth if they grant leave (without loss of seniority) to employees for sickness or disability due to medical condition. Nev. Rev. Stat. Ann. § 613.4383. This template is intended for private employers and may be included in an employee handbook or distributed as a standalone policy.
