Power of Attorney for Minor Child
(VT)
Summary
This power of attorney for minor child is for use in Vermont by a parent who wishes to temporarily delegate parental powers to a designated agent. This template includes practical guidance, drafting notes, and alternate and optional clauses. Vermont law does not provide a statutory mechanism for the temporary delegation of parental powers. However, powers of attorney for minor children, such as this template, are commonly used to ensure that minor children have a continuity of care in the event that a parent is unavailable. Alternatively, parents may utilize a consensual guardianship pursuant to Vt. Stat. Ann. tit. 14, § 2626 as a means of ensuring minor children are cared for in the event that the parents are not able to provide such care. For additional information on guardianships for minor children, see Vt. Stat. Ann. tit. 14, § 2621 et seq. For a checklist identifying considerations to address with a client in an emergency or time-sensitive situation, such as the COVID-19 pandemic, see Estate Planning in an Emergency Checklist (Covid-19). For a durable power of attorney, see Power of Attorney (Durable, General) (VT). For additional documents for use in Vermont, see Will for Single Individual (Optional Trust(s) for Children) (VT), Will for Individual with Spouse or Partner (Optional Trust(s) for Spouse and/or Children) (VT), and Health Care Proxy (Long Form) (VT).
