Summary

This Illinois statutory short form power of attorney template may be used to grant an agent powers to act with respect to real property and related matters in Illinois owned by another, commonly referred to as the principal. This template includes practical guidance and drafting notes. Pursuant to 755 Ill. Comp. Stat. Ann. 45/3-3, a statutory short form power of attorney for property in Illinois must contain (1) notice to the individual signing this template, (2) the required Illinois statutory short form power of attorney for property, and (3) notice to the agent, all as provided in this template. This template must also contain the notarized acknowledgment provided herein. Pursuant to 755 Ill. Comp. Stat. Ann. 45/3-4, the agent is required to act in good faith for the benefit of the principal using due care, competence, and diligence in accordance with the terms of the statutory property power. This power of attorney for property will remain in effect during the lifetime of the principal unless terminated.
