Summary
The property owner's land was damaged as a result of a flood. In its complaint, the property owner alleged that the city was negligent in construction of storm reservoirs and that the city's negligence was the proximate cause of damage to the property owner's land. On appeal, the court held that from a view of the whole charge, the jury had been given a comprehensive instruction regarding the meaning of technical terms used in the charge. Moreover, the court held that it was unable to find the supposed infirmities in the trial court's charges to the jury.
