Performer Agreement

Summary
This agreement is used to engage a loan-out company for the services of a union performer in an independent motion picture. This template includes practical guidance, drafting notes, and alternate and optional clauses. The agreement is drafted from the perspective of the production company, however, optional and alternate provisions are incorporated to establish an equitable balance between the parties. The performer will be engaged on a work for hire basis and compensated in accordance with SAG-AFTRA Schedule F, which allows a buyout fee on motion pictures exceeding a specified budget threshold. The contract stipulates that in the event of a conflict between this agreement and the SAG agreement, the SAG Agreement will take precedence.
