Summary

Patent counsel are often asked to conduct a patent clearance search to determine whether a client's intended use, manufacture, or commercialization of a new product would infringe any third-party patent rights. The results of the search are typically communicated to the client in a written opinion—either a patent clearance opinion or as part of a freedom to operate opinion (also known as a "right to use" opinion).
