Summary
The former office manager had told plaintiff that she was resigning to spend more time with her family. Not long after her departure, plaintiff discovered defendants' advertisement of a competing tax preparation company that had been created. The trial court concluded that the restrictive covenants contained in the former office manager's employment contract with plaintiff were enforceable; that the former office manager had breached those covenants; and that the names and addresses of plaintiff's past customers constituted a trade secret. On appeal, the court agreed with defendants that the trial court abused its discretion by entering an overly-broad injunction against them since the restrictive covenants in the employment contract were unenforceable as overbroad since they failed to properly limit the territory to which it applied.
