(PTO) Policy (NV)


Summary

This template is a paid time off (PTO) policy that grants employees in Nevada paid time off from work for a variety of reasons in lieu of an individual vacation policy, sick leave policy, or personal leave policy. This template includes practical guidance, drafting notes, and alternate and optional clauses. Nevada maintains an earned paid leave law that governs private employers with 50 or more employees. Nevada. 2019 NV S.B. 312, § 1(9)(B). Employers must provide employees with at least 0.01923 hours of paid leave for each hour of work performed, and such leave can be used for any reason, including sickness. 2019 NV S.B. 312, § 1(1)(A), (2). Employees are not required to provide a reason for the leave to their employer, however they are required to provide notice as soon as practicable. 2019 NV S.B. 312, § 1(2)(B). An employer shall allow an employee to use paid leave for any use, including, without limitation: • Treatment of a mental or physical illness, injury or health condition; • Receiving a medical diagnosis or medical care; • Receiving or participating in preventative care; • Participating in caregiving; or • Addressing other personal needs related to the health of the employee. Nev. Rev. Stat. Ann. § 608.0197(2)(b). This template is intended for private employers and may be included in an employee handbook or distributed as a standalone policy.
