Paid Time Off (PTO) Policy
(KY)

Summary

This template is a paid time off (PTO) policy that grants employees in Kentucky paid time off from work for a variety of reasons in lieu of an individual vacation policy, sick leave policy, or personal leave policy. This template includes practical guidance, drafting notes, and alternate clauses and optional clauses. There is no law in Kentucky that requires private sector employers to provide paid leave to employees. However, the Kentucky Labor Cabinet takes the position that whether an employer must provide leave, or pay employees for unused vacation/leave upon termination, depends on the employment contract, and the employer's existing policy or past practice. This template is intended for private employers and may be included in an employee handbook or distributed as a standalone policy. For a non-jurisdictional employee handbook, see Employee Handbook. This template's language complies with both Kentucky and federal law. It is similar to the non-jurisdictional Paid Time Off (PTO) Policy, except that the content addresses issues specific to Kentucky. For information on drafting paid time off policies, see Paid Time Off (PTO) Policies: Key Drafting Tips. For information on Kentucky laws governing paid time off, see Leave Law (KY). For state-specific annotated PTO polices, which include vacation leave, see the Other Leaves column of the Attendance, Leaves, and Disabilities State Expert Forms Chart. For a non-jurisdictional policy governing vacation leave only, see Vacation Policy. For a non-jurisdictional policy governing sick leave, see Sick Leave Policy. For a non-jurisdictional personal leave policy, see Personal Days Policy or Personal Leave of Absence Policy.
