Summary

This template is a paid sick leave policy (with acknowledgment) that governs private employees' sick leave rights in Nevada. This template includes practical guidance, drafting notes, and alternate and optional clauses. Employers may include this policy in an employee handbook or distribute it as a standalone policy. It is intended for private employers. This template differs from the non-jurisdictional Paid Sick Leave Policy (with Acknowledgment) as its language has been customized to comply with Nevada law. Employers who employ 50 or more employees in Nevada are required to provide Paid Time Off (PTO) for unspecified personal use. Nev. Rev. Stat. Ann. § 608.0197. This PTO may be used for any use, including as sick leave. Nev. Rev. Stat. Ann. § 608.0197(2)(b). Accordingly, employers may prefer to adopt a single PTO policy providing employees with paid time off for various reasons in lieu of adopting individual vacation, sick leave, and absence policies. This template is intended for use by employers who elect to institute a paid sick leave policy if the employer employs fewer than 50 employees in Nevada or if the employer elects to institute a sick leave policy separate from general PTO. If an employer provides paid or unpaid sick leave, that sick leave is subject to the requirements of Nev. Rev. Stat. Ann. § 608.01975, as addressed below. Additionally, under the federal Family and Medical Leave Act (FMLA), some employers are required to provide up to 12 weeks of unpaid time off which may be used as sick leave. Local laws may require employers to offer sick leave to employees. Therefore, you should check local laws for any sick leave requirements.
