Summary

This practice note lists the originating documents required for family law matters that fall under the jurisdiction of the Supreme Court, as well as the details pertaining to each. In particular, it explains family law cases that are started by Requisition, which, may occur where there is no existing family law case; particulars of the Petition, such as the types of orders that must be sought, the rules that govern the form and hearing thereof, supporting documentation and requirements for notice; process for bringing a joint family law case, which may be started by both persons involved if all relief is consented to, save for any claim for divorce; and the impact of using the wrong originating document.
