Order (Substitute Service) (ON)


Summary

This precedent is a sample order for substituted service of a notice of examination in aid of execution pursuant to r. 34.15(1) of the Ontario Rules of Civil Procedure, R.R.O. 1990, Reg. 194 ("Rules"). This precedent contains practical guidance. An Order (Form 59A) (ON) sets out the written direction/command of the court for a step in a proceeding, for example a motion, and is signed by a judge, associate judge (formerly called "master") or the registrar. An order must include: (1) the name of the judge/associate judge or judicial officer who made it; (2) the date on which the order was made; and (3) a preamble that includes particulars sufficient to understand and contextualize the order made, such as: (a) the date of the hearing; (b) the parties who were present or represented by counsel (and participated in the hearing) and those who were not; and (c) any consents, statements of lack of opposition, undertakings or admissions given by the parties (or those served with the motion ...
