Omitted Child Clause
(FL)

Summary

This template is an omitted child clause for use in a Florida will. This template contains practical guidance, drafting notes, and optional clauses. Use this template for any of the following purposes: 1) excluding a child entirely from the will, 2) providing a smaller inheritance to one child than to others, 3) limiting an inheritance to assets passing under a separate trust, and 4) limiting an inheritance to lifetime gifts already received. The template also addresses how to prevent a disinherited child from being nominated to a fiduciary role by operation of law. For a full listing of key clauses for use when drafting last wills and testaments, see Will Clauses Resource Kit. For further discussion of wills, see Purposes and Uses of a Will (FL), Requisites, Instrumentation, and Will Provisions (FL), and Revocation, Revival, Amendments, and Will Contests (FL).
