Summary

This notice to tenant regarding abandoned property template may be used by a landlord in Florida to notify a residential tenant that the landlord intends to dispose of personal property left in the leased premises following the termination or expiration of the tenant' s lease or the tenant' s abandonment of the premises. This template contains practical guidance, drafting notes and an alternate clause. In Florida, if a residential or commercial tenant leaves personal property at the premises following the expiration of the lease or his or her abandonment of or eviction from the premises, the landlord must give notice to the tenant or the property' s presumed owner of its intent to dispose of it. The notice must describe the personal property sufficiently to allow the owner of the property to identify it. The notice is also required to advise the owner that the reasonable costs of storage may be charged before the property is returned and state where the property may be claimed and the date before which the claim must be made, which shall be a date not fewer than 10 days after the notice is personally delivered or, if mailed, not fewer than 15 days after the notice is deposited in the mail. The notice must be personally delivered or sent first class mail to the owner' s last known address or any other address where the owner can reasonably be expected to receive it. Fla. Stat.
